Important Legal Notice: Data Backups & Service Permanence

By using TCG Deck-Rec ("the Service"), you acknowledge that our services and servers may be modified, suspended, or permanently shut down at any point in time. You are solely responsible for exporting and backing up your own decks, collections, and custom card data. We bear no liability and provide no refunds in the event of server shutdown, site closure, service discontinuation, or data loss.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and TCG Deck-Rec ("we", "us", or "our"). By creating an account, accessing, or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. Service Availability, Downtime & Server Shutdown

We strive to maintain high availability; however, we do not guarantee continuous, uninterrupted, error-free, or permanent operation of the Service.

  • Right to Terminate or Shut Down: We reserve the absolute right to modify, suspend, restrict, or permanently shut down the Service, our servers, or any individual feature at any time, for any reason, with or without prior notice.
  • No Liability for Outages: We shall not be liable to you or any third party for any suspension, disruption, technical failure, maintenance downtime, or permanent cessation of the Service.

3. User Data, Export Responsibility & Data Loss

TCG Deck-Rec provides built-in tools allowing users to export decks, collections, booster drafts, and custom card files.

  • Sole Responsibility to Back Up: You expressly agree that you are solely responsible for regularly exporting, saving, and backing up your decks, card collections, custom card creations, and account data to your own local storage or external devices.
  • No Duty to Preserve Data: We have no duty or obligation to maintain, retain, recover, or deliver copies of your data in the event of an infrastructure crash, database corruption, software bug, hosting provider failure, or service shutdown.
  • Zero Liability for Data Loss: We accept no liability, financial responsibility, or obligation to compensate you for any lost, deleted, inaccessible, or corrupted data under any circumstances.

4. Purchases, Subscriptions, AI Tokens & No-Refund Policy

The Service may offer virtual goods, including AI Tokens, credit packs, and recurring Premium subscriptions processed through third-party payment providers (e.g., Stripe).

  • All Sales Are Final: To the maximum extent permitted by applicable law, all purchases of AI Tokens, credit packs, digital items, and subscriptions are final, non-refundable, and non-exchangeable.
  • No Cash Value: AI Tokens and virtual credits constitute a limited, revocable license to access specific AI features on the platform. They have no monetary value, cannot be redeemed for fiat currency, and do not accrue interest.
  • No Refunds Upon Server Shutdown or Closure: In the event that our servers are taken offline, the platform shuts down, or the Service is terminated, you are not entitled to any full or prorated refund, chargeback, or monetary compensation for unused AI tokens, active subscription periods, or lost access.
  • Subscription Cancellations: You may cancel your recurring Premium subscription at any time via your Account Settings or billing portal. Upon cancellation, your subscription will remain active until the end of the current paid billing cycle without refund of previously charged amounts.

5. AI Generation & Content Disclaimer

Deck lists, archetype analyses, synergy evaluations, rulings guidance, and custom card artworks generated by our AI models are provided for informational and entertainment purposes only. While we endeavor to ensure high quality and up-to-date card information, we do not guarantee the tournament legality, competitive viability, factual correctness, or rule accuracy of any AI-generated recommendations.

6. Third-Party Links, APIs & Intellectual Property

TCG Deck-Rec is an unofficial, fan-created tool. All card names, images, trademarks, and associated intellectual property for Magic: The Gathering (Wizards of the Coast / Hasbro), Pokémon (Nintendo / Creatures / GAME FREAK), Yu-Gi-Oh! (Konami), Disney Lorcana (Disney / Ravensburger), Star Wars: Unlimited (Fantasy Flight Games / Lucasfilm), and other respective games are copyright and trademark of their respective owners.

Our website contains links to external platforms (including TCGPlayer affiliate links and third-party card APIs). We are not responsible for the availability, terms, privacy practices, or fulfillment of orders placed on third-party websites.

7. Disclaimer of Warranties ("AS IS" & "AS AVAILABLE")

THE SERVICE IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TCG DECK-REC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND CONTINUOUS OR UNINTERRUPTED AVAILABILITY.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TCG DECK-REC, ITS OPERATORS, FOUNDERS, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE USE OF, INABILITY TO USE, SERVER SHUTDOWN, OUTAGE, OR CESSATION OF THIS SERVICE.
